No. A Superfund site is any land in the United States that has been contaminated by hazardous waste and identified by the Environmental Protection Agency (EPA) as a candidate for cleanup because it poses a risk to human health and/or the environment. EPA has no identified the BKK Landfill as a Superfund site.
The Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) is the federal program that allows the EPA to fund the cleanup of sites contaminated with hazardous substances and pollutants. CERCLA gives EPA the funds and authority to clean up contaminated sites that are abandoned or have no viable responsible party. Sites managed under this program are referred to as "Superfund" sites.

The only components that are purposed to be built on top of the landfills are the Public Park (on top of the Class III - municipal landfill) and the Solar Greenhouse Facilities (on top of the Class I and Class III). This is contingent on approval by the Regulatory Agencies and BKK Corporation (the property owner). The City has not approved a project. The City has selected the proposal submitted by Singpol Group LLC and authorized the City Manager to execute a Letter of Intent (LOI). The LOI allows the City and Singpol to further pursue the feasibility of Singpol's proposal. The proposal is still a concept and will go through the necessary entitlement process for City approvals, as well as obtain the necessary approvals from the Regulatory Agencies.

There have been no Prop. 65 (also known as the Safe Drinking Water and Toxic Enforcement Act of 1986) notices since 2007. In 2010, DTSC evaluated subsurface soils in the residential area and found no evidence that landfill gas was migrating into the area. Currently the EE/CA and RI/FS are evaluating the integrity of the landfill systems and groundwater for potential impacts from the landfill.

Currently the Department of Toxic Substance Control (DTSC) and the potentially responsible parties (PRPs) are near completion of the engineering evaluation and cost analysis (EE/CA) for three main landfill systems: cover, gas extraction and treatment, and leachate extraction and treatment. The EE/CA also evaluates the leachate treatment plant (LTP) and liquid disposal options. The EE/CA Report will summarize the Class I Landfill investigations and provide a summary of possible remedies. The draft EE/CA report is expected to be completed in 2019. On a separate timeline, DTSC and the PRPs are conducting a remedial investigation and feasibility study (RI/FS) to determine the nature and extent of groundwater contamination. No date has been determined for the completion of the draft RI/FS report. Based on the findings of the EE/CA and RI/FS and community comments, DTSC will determine and select a final remedy for the Class I Landfill.Development Opportunity Site - Former BKK Landfill Site
